Welcome to Sama Sama. These Terms & Conditions govern your access to and use of www.samasama.co.za ("the Website") and your purchase of products from our online store.

By using this Website or placing an order, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions. If you do not agree, please refrain from using this Website.

About Sama Sama

Sama Sama is a South African clothing brand creating thoughtfully designed garments in limited quantities using a considered approach to design and production.

Throughout these Terms & Conditions, "Sama Sama", "we", "our" and "us" refer to Sama Sama.

Eligibility

By placing an order you confirm that:

  • you are at least 18 years of age or have the permission of a parent or legal guardian;

  • the information you provide is true and accurate;

  • you are authorised to use the payment method selected.

Orders

Submitting an order constitutes an offer to purchase a product.

All orders are subject to:

  • product availability;

  • payment authorisation;

  • acceptance by Sama Sama.

An order confirmation email confirms receipt of your order but does not constitute acceptance. We reserve the right to refuse or cancel any order before dispatch, including where products become unavailable, payment cannot be verified, pricing errors occur or fraudulent activity is suspected.

Should an order be cancelled after payment has been received, a full refund will be processed using the original payment method.

Pre-Orders

Certain Sama Sama pieces are available on a pre-order basis. This allows us to produce garments in thoughtful, limited quantities, helping us reduce overproduction while ensuring each piece receives the care and attention it deserves.

By placing a pre-order, you acknowledge and agree to the following:

Availability

Pre-order items are not yet in stock at the time of purchase. Production will begin, or may already be underway, once orders have been placed.

Estimated Dispatch Dates

Estimated dispatch dates are provided on each product page as a guide. While we do our best to meet these timeframes, production schedules may occasionally change due to factors outside of our control, including fabric availability, manufacturing timelines or shipping delays.

Should there be any significant delay, we will notify you via email as soon as possible.

Payment

Full payment is required at the time your pre-order is placed. This secures your garment within the production run and allows us to begin preparing your order.

Combined Orders

If your order contains both in-stock and pre-order items, your order may be shipped together once the pre-order item is ready. Should you require in-stock items sooner, we recommend placing separate orders.

Changes & Cancellations

As production is carefully planned according to customer orders, pre-order purchases cannot always be cancelled or amended once production has commenced. If you need assistance, please contact us as soon as possible and we'll do our best to help.

Our Approach

Producing in small batches allows us to create more intentionally, reduce unnecessary waste and focus on quality over quantity. Thank you for supporting a slower, more thoughtful approach to fashion.

Product Availability

Many Sama Sama garments are produced in small batches.

Although every effort is made to ensure accurate stock levels, inventory discrepancies may occasionally occur.

Should a product become unavailable after purchase, we will contact you promptly and offer either:

  • a full refund;

  • store credit; or

  • a suitable replacement, if available.

Product Information

We endeavour to ensure that all product descriptions, measurements, fabric compositions and imagery are as accurate as possible.

Please note:

  • colours may vary slightly between screens and devices;

  • natural fibres may display subtle variations in weave, texture or colour;

  • measurements are approximate and may vary slightly between garments.

These variations do not constitute manufacturing defects.

Pricing

All prices are displayed in South African Rand (ZAR).

Prices include VAT where applicable.

Prices may change without prior notice; however, once an order has been confirmed and accepted, the confirmed purchase price will apply.

Delivery charges are calculated separately during checkout.

International customers may be shown prices in their local currency where available. Exchange rates are indicative only and your payment provider may apply different conversion rates.

Import duties, customs charges, local taxes and clearance fees imposed by the destination country remain the responsibility of the customer.

Pricing Errors

While we take reasonable care to ensure pricing accuracy, errors may occasionally occur.

If an incorrect product price or shipping charge has been displayed due to a technical, typographical or administrative error, Sama Sama reserves the right to cancel the affected order before dispatch.

If payment has already been processed, you will be notified as soon as reasonably possible and offered either:

  • a full refund; or

  • the opportunity to proceed with the purchase at the correct price.

Payment

Payments are processed securely through our approved payment providers.

Available payment methods may include:

  • Visa

  • Mastercard

  • Debit Cards

  • Instant EFT

  • EFT

  • Apple Pay

  • Google Pay

  • Other payment methods displayed at checkout.

Payment options may change without prior notice.

Orders will only be processed once payment has been successfully authorised.

EFT Payments

If paying via EFT:

  • please use your order number as your payment reference;

  • payment must be received within 24 hours of placing your order;

  • unpaid orders may be cancelled automatically.

Depending on your financial institution, EFT payments may take up to 2–3 business days to reflect.

Delivery

Orders are dispatched on Tuesdays and Thursdays.

Orders placed after Thursday's dispatch window will be included in the following dispatch cycle.

Estimated delivery times are:

  • South Africa: approximately 4–6 business days after dispatch.

  • International: delivery times vary depending on destination.

Delivery estimates are provided in good faith and are not guaranteed. Delays caused by couriers, customs, weather events, public holidays or other circumstances beyond our reasonable control may occur.

International Orders

International customers are responsible for:

  • customs duties;

  • import taxes;

  • VAT charged by their country;

  • customs clearance fees;

  • any additional government charges.

These charges are not included in your purchase price.

Should an order be refused or returned because customs charges were not paid, the original shipping costs are non-refundable.

Returns & Exchanges

Our Returns Policy forms part of these Terms & Conditions.

Please refer to our separate Returns Policy for eligibility requirements and return procedures.

Nothing contained within these Terms limits or excludes any rights available to consumers under the Consumer Protection Act, 68 of 2008.

Sale Items

Products purchased during promotional periods or marked as discounted are considered Final Sale.

Sale items are not eligible for refunds or exchanges due to:

  • change of mind;

  • incorrect size selection;

  • personal preference.

This does not affect your statutory rights under the Consumer Protection Act.

Where a discounted product is found to be defective, unsafe or not of acceptable quality, you remain entitled to the remedies available under South African consumer law.

Intellectual Property

All content on this Website—including photographs, graphics, illustrations, branding, logos, artwork, designs, copy, layouts and trademarks—is owned by or licensed to Sama Sama and is protected under applicable intellectual property laws.

No content may be copied, reproduced, distributed or used for commercial purposes without our prior written consent.

Privacy

Sama Sama respects your privacy and processes personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).

We collect personal information only where reasonably necessary to:

  • process and deliver your order;

  • communicate with you regarding your purchase;

  • provide customer support;

  • improve our products and services;

  • comply with our legal obligations.

Your information may be shared with trusted third-party service providers including payment processors, courier companies and technology providers where necessary to fulfil your order.

We do not sell your personal information.

You may request access to or correction of your personal information by contacting us at support@samasama.co.za.

Website Use

You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of others or interfere with the operation of the Website.

You may not:

  • use the Website for fraudulent purposes;

  • interfere with the Website's security;

  • introduce malicious software;

  • attempt unauthorised access to any systems connected to the Website.

These links are provided solely for your convenience.

Sama Sama does not control or endorse third-party websites and accepts no responsibility for their content, privacy practices or availability.

Disclaimer

To the fullest extent permitted by law, Sama Sama shall not be liable for indirect or consequential loss arising from the use of this Website.

Nothing contained in these Terms excludes or limits any rights that cannot lawfully be excluded under the Consumer Protection Act or any other applicable legislation.

Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising from these Terms or the use of this Website shall be resolved in accordance with the applicable laws and courts of South Africa.

Changes to these Terms

We reserve the right to amend these Terms & Conditions from time to time.

Any updates will be published on this page and will become effective immediately upon publication.

Continued use of the Website following any changes constitutes acceptance of the revised Terms.
